Two Camera Package Contract
Payment Terms
1. The acceptance of the booking outlined on the booking form, once completed, is based on agreement by the client of the terms and conditions stated herein.
2. The total cost payable by the client for Vlog My Wedding video package is guaranteed at the time of booking to the client. The total cost payable by the client is £xxxx for the Vlog My Wedding video package. The package details are included on the invoice sent at the time of booking. Any additional package upgrades after the wedding date will be priced according to current prices at the time of the request.
3. The client has secured the booking with a £50 deposit and this is a non-refundable retainer which will secure Vlog My Weddings services for the date of the wedding and bookings cannot be confirmed until this money has been received.
4. The balance outstanding will be paid the latest one month prior to the date of the wedding.
5. In the event of a booking cancellation, Vlog My Wedding will retain 100% of the non-refundable deposit paid under all circumstances. Should the Client wish to cancel this contract at any time, notice of cancellation must be given in writing to Vlog My Wedding. In such circumstances, the Client will be liable to pay Vlog My Wedding the following sums; notice received 60 days prior to the date of Event or more: Deposit only. Notice received less than 60 days but more than 30 days: 50% of the agreed balance due will be payable. Notice received of 14 days or less: 100% of the agreed balance will be payable.
6. The client will be entitled to vary the package provided that the package is to the same value or greater. The variation in package will be dependent on the availability of the additional equipment required.
Service provided by Vlog My Wedding
1.Vlog My Wedding agrees to hire X video camera(s) with a tripod with X recording time, which must be used for the purpose of filming the Client’s wedding day only.
The rental period will run from 00/00/2000 - 00/00/2000 inclusive.
The equipment will arrive by courier by 17.00 two days before the wedding and will be collected by courier between 9am and 5pm the next working day after the clients wedding.
2. Vlog My Wedding agrees to edit the footage from the wedding day into three chapters on a USB; the best bits (XX mins max), the ceremony in full and speeches in full. Vlog My Wedding will be unable to fulfil these package specifications if the footage is not captured on the day. Vlog My Wedding will not be held accountable for any refund under these circumstances as the equipment has been provided for the event.
3. The edit can take up to 12 weeks to deliver after the return of the equipment and memory cards. The edit that the Client receives is final. Any acceptance of work thereafter does not need to be accepted by Vlog My Wedding. Any agreement to work on changes will be charged at £60 an hour.
4. Vlog My Wedding cannot store data for longer then 4 weeks after the USB has been dispatched. It is the Client’s responsibility to check the USB thoroughly and highlight any issues in writing prior to this date. Failure to do so will result in Vlog My Wedding being unable to rectify any issues and Vlog My Wedding will not be accountable.
5. In the unlikely event that Vlog My Wedding cannot perform the Service agreed upon; it is understood that, Vlog My Wedding will only be responsible for the return of all the money paid to date. Vlog my Wedding will take the utmost care with respect to delivery, editing and delivery of final video footage. In the event that circumstances arise that are beyond the control of Vlog My Wedding, Vlog My Wedding’s liability is limited. Liability is limited to a return of all the money paid to date and nothing in addition.
6. Vlog My Wedding reserves the right to refuse rental service to anyone at anytime where we deem it is in our best interest on the basis of credit, past history, lack of safety precaution, or likelihood of abuse. Vlog My Wedding may also refuse rental service at anytime and our obligation under any contract executed will be void should we discover that the intended use of the equipment presents a serious safety hazard and/or violates any constitution or law.
Clients Responsibility
1. The client agrees to package the equipment in the boxes provided by Vlog My Wedding and agree an address for delivery and collection two weeks prior to the wedding date. Please note that we cannot guarantee a specific time for collection so bear this in mind when deciding on an address. If for any reason the courier is unable to deliver or collect the equipment on the agreed date, the client will be liable for the cost of re-booking and will be charged £50 per day per camera. It may be beyond our control to redeliver the equipment if there is a failure to accept the delivery on the agreed date. Failure to aid the collection of the equipment may result in additional costs related to contract bookings awaiting the equipment.
2. The Client agrees to check that all of the equipment as listed in the package details is present on the acceptance of the delivery. The client agrees to examine the video cameras, batteries, tripod and microphone prior to the wedding to ensure that they are in good working order. If there are any technical or operator issues at this point, the Client agrees to raise them with Vlog My Wedding at least 24 hours prior to the wedding day. The Client also agrees to return the equipment in the same condition as when it was received.
4. The Client is solely responsible for the equipment, and those who use it, whilst it is in their possession and accepts full responsibility for loss or damage to the equipment. The Client shall use the equipment in a skillful and proper manner and shall take all precautions necessary to ensure its safety and security. The Client is solely responsible for ensuring that the cameras are filming throughout the course of the wedding day. Vlog My Wedding cannot be held responsible for the lack of footage, poor quality of filming and the loss of memory cards from the wedding day. All memory cards must be returned with the kits.
5. The equipment remains at all times the property of Vlog My Wedding. The Client shall have no right over the equipment and cannot sell, lease or sub-contract under any circumstances.
6. By entering into this contract the Client accepts the conditions of the insurance policy taken out by Vlog My Wedding.
7. In order to comply with the terms of our insurance policy the Client agrees to operate the equipment with care and consideration and only for the purpose of filming the wedding day. The Client agrees to not leave the equipment unattended at any time or leave it susceptible to loss or damage and not leave the equipment in an unattended vehicle.
8. The equipment will be left in the care of the Client in good working condition and any damage, loss or theft of the equipment will be charged to the Client up to a maximum of £250 to cover the cost of the insurance excess. In this instance, the Client agrees to contact Vlog My Wedding immediately and Vlog My Wedding cannot be responsible for the resulting lack of footage. Any misuse of the equipment which is not covered by the insurance company will be charged to the client to recover the costs of the equipment. In the case of theft, the police will be contacted.
Copyright and Consent
1. Vlog My Wedding reserves the right to use any footage for promotional or any other uses of public display. This includes imagery of the client and the client’s guests. The video is produced for the Client’s personal, private, in-home use. The Client assumes all liability for any form of copyright infringement and is responsible for any personal releases.
2. The copyright of all video footage is shared by Vlog My Wedding. We (the clients) give permission to Vlog My Wedding to use any footage of our wedding and as required subsequent usage and for general promotional advertising for Vlog My Wedding on platforms. The client is aware that Vlog My Wedding has a dedicated page on the Everybody Smile Photography website and as such the footage and details may be used seen there in addition to other platforms.
3. The client agrees to indemnify Vlog My Wedding and its’ employees and agents from and against all losses, damages, claims, or liability of any kind whatsoever, including legal expenses, arising from the use, condition (including, with limitation, latent or other defects) or operation of the equipment, and by whosoever used or operated the equipment during the rental period. Vlog My Wedding is not responsible for accident or injury caused directly or indirectly by the use of the rented equipment.
4. It is the client’s responsibility to make their guests aware that video footage is being obtained of them. Vlog My Wedding reserves the right to use footage of the client’s and their guests for promotional purposes or any other uses of public display. The client and/or their guest(s) have the right to withdraw this consent at any point.
By signing below the client agrees that they have read, fully understood and accept the terms and conditions of this Contract.
